UK Court: videogame ideas can be copied
The terrific Tobold points us to this article about a ruling in the UK's Court of Appeal that has ramifications for our whole industry. The judge there says that ideas behind computer games can be freely copied-- it's only the source code and the graphics that cannot. Tobold ties this directly into connections players have been making between Lord of the Rings Online and WoW-- the two systems have lots of similarities (the UI layout is almost exactly the same at first glance)-- and says that Blizzard, for example, would never be able to sue Turbine, maker of LotRO.Of course IANAL, but I'm pretty sure this isn't a groundbreaking ruling. While graphics and the code are undoubtedly covered by copyright (because you can clearly look at them to tell whether they're identical or not), it doesn't seem like gameplay ideas would be-- game designers have always borrowed popular ideas from each other, going all the way back to the idea of experience points and hit points. Even something like Madden's "Playmaker" feature can be copied-- while other companies can't call their feature "Playmaker," they can definitely use the analog stick to direct plays.
Besides, if you ask me, Blizzard has nothing to worry about, especially from LotRO (I hear Turbine couldn't get the rights to the movies, so while you may see the Treants or visit Lothlorien, it won't be anything you recognize from the films). The magic of Blizzard's game is in the design and the polish of how it's put together. Even they borrowed familiar MMO ideas to try and improve on them, and I'm sure they have no problem with Turbine doing the same thing.

To use the suitable abbreviation IANYL, however this ruling adds little to the varying concepts of intellectual property and the tort of “Passing Off” as established in the case of Bollinger v Costa Brava (Champaign trade mark case)
The basic rules in this regard are outlined in the case of Warnick v Townend & Sons ltd. If one product is so similar to another that it confuses the customer base of the Former, causes them actual or potential damage, injures goodwill or trademark of the former and importantly, is in a common course of trade then they are prima facia liable for any damage resulting. There are of course exceptions and qualifications as with all areas of the Law, but in general, this ruling seems to add little to the current law other than highlighting that the situation which was thought to exist, does indeed exist.
It’s in a similar vein to how you would view Harry Potter films having Goblins, or 28 Days later having Zombies. It’s variation on an original theme that does not pretend to be the original material. If it gets to the point that both are similar to the point of confusion, then the rights of the original have been breached.

I'll admit the graphics for WoW aren't top tier (deliberate by Blizzard to be less taxing on video cards) but the graphics for the new LotR ring really sucks in comparison.
Oh... and the UI layout is an obvious rip. Calls into question how many other ideas the LotR development team were unable to be creative about.

Great post, Falgorn. And it's not like WoW has taken any of its design elements from, oh, I don't know, Ultima Online (cursor and books are blatant imo), emotes from your favorite MUD (copyrighted or no), and, well, elves, gnomes, humans, and dwarves running around tossing virtual d20s seems very close to a particular RPG I was playing a quarter-century ago. ;^)
Was just thinking today how many years ago it's been since I read about the thief-acrobat in Dragon magazine... (apparently it was issue 69, written by ole GG himself, but I digress)

WoW is a rip too. They gathered their ideas from EQ and DAoC. In fact I'd go so far as to say there is nothing really original about WoW.
Its fun.
Its casual-friendly.
But new? Nah.
Even their BGs are taken from years of FPS multiplayer matches.
Capture the flag, Zerg, and Capture and Hold.

MEO ripping off the WoW interface?
For those that don't know, the makers of MEO, Turbine Entertainment are using the same engine that they used in Asheron's Call 2 (which was before WoW and 'it's interface') and Dungeons and Dragons Online (which WoW 'borrowed' many things - beyond graphical interface concepts - eg; different difficulties for dungeons, etc)

Checked out some screenshots and video of LotRO, WOW! (no pun intended :), if they're using the AC2 engine they sure polished the hell out of it. Looks like what WOW 2 would look IMHO.
I have to agree with HiWay, after 2 years of playing WOW, it'll be nice to try something the same but different (BC is too cookie-cutter for my taste, when I first entered Hellfire and saw lev 60-ish boars running around, I decided it was time for something new)
and why does lotroinsider.com take me to allakhazam?? didn't you guys at xbox360/secondLife/wow/etc.etc.--insider think to grab what could be the next big hit in MMO's?
then again, if LotRO sucks, i could always wait for the next WOW xpac and have loads of fun fighting level 80 boars... something to look forward to :)
