Yeah, I don't see how there's any kind of argument to be made that the other hunter was somehow "owed" the pet because he was closer to it when it spawned, whether or not he was actually present to be able to do something about it. Maybe there are some nuances of hunter pet-taming etiquette that I just don't know.
