While I think it was wrong to have used the item, I never thought perma-ban was justified. I very highly doubt that they could possibly hack Bliz and send the item to the guild. And even if they did, unless Bliz has a solid proof, I think you have to give them the benefit of the doubt.
A short term suspension while investigating the matter, then rolling back the account to right before they got the item would've been a much more appropriate response.
