I'm pretty sure this is going to be battle.net account-wide. Meaning that they will be able to see you no matter what you're doing. Its a bit much, but its no different than facebook or some other social networking application.

I agree with the privacy bit though. Including an "invisible" option would be very wise on Blizzard's part.
