But can't they just spec there 81st level talent point on this talent without a need to respec?

They could--if they didn't want to spend as many points outside of Frost later on. It would mean the points they don't put in Frostfire Orb would be put somewhere else in the Frost tree that isn't such a straight dps increase (so they can advance further down the tree) and also that the mage would have less to put in Arcane and Fire after they hit their 31 point mark in the Frost tree.
