It's not a new bug by any means; it's been an issue ever since pets (and it affects all of 'em) started scaling at all. The critter spawns, then scales, and then heals to their new full.
As long as the pet doesn't get hit, I've never seen them not top off, and sometimes they'll fill up after taking a (non-fatal) hit. And then there's all the times they'll take a quick hit and the game decides that that's where the pet's health level will stay.
It does seem to be a smaller window for it to bug than it once was, but I'm not sure if that's random chance or if Blizzard has actually improved things; I don't play pet classes as much as I once did.
