This has already been confirmed. The mechanism will be that you will submit two pieces of armor to the transmogrifier NPC, he will then alter the target to look like the source while retaining it's stats. So indeed you cannot do this with armor you don't own.

Well somewhat, I don't think it will bind an item but they did say it will not destroy either piece, so presumably you could borrow an unused BoE item from a guildie, transmog it's look and give it back.
