If it truly was an ex-employee of Blizzard who leaked the images and video, his ass is in for a world of lawsuit hurt.
You don't sign NDA's for no reason. And most NDA's apply even after you leave a company, or you have to sign another NDA when you leave.

One where there's no news about GW2.

D3 wasn't leaked. The beta was released and there is no non disclosure agreement for the beta. So it can be streamed and shown everywhere.
