Have it be BoE. Let people buy one and sell it on the AH so that "players who don't want to spend real money to add these pets to their collection". But when someone uses it to add the pet to one of their characters, have it unlock the pet as BoA for the rest of the characters on that account.

Blizz still gets what they want out of the pet, and those of us that don't want to pay for each of their alts get what we want. Win/Win.

As it is right now, I'm thinking downrating it when it pops up on Warcraftpets.com is in order.
